      历史解释是服务于某种合理的法律解释目标且具有相对独立性的法律解释方法,其通过考察立法过程并借助立法历史资料探求法律制定时的立法意图,但历史解释并不止步于对立法原意的发现,立法原意可被再判断或评估。从法律适用的理由论辩角度看,制定法历史解释可以发挥独立性的、限定性的、决断性的、补充性的论辩效力。基于规范前史的解释、基于规范创建史的解释和基于规范适用及发展史的解释,是历史解释论辩效力的实现路径。法律规范具备在文本之外进行解释的必要空间,且借由立法历史资料形成的解释倾向存在合理性,是历史解释论辩效力的发生前提。历史解释方法也有其运作界限,即历史解释不能从根本上脱离法律文本的可能文义限制;开展历史解释不能把立法原意绝对化或片面化,而应根据社会现实的变化对历史观点作审慎判断;历史解释的论辩效力强度受制于立法原意的清晰程度;历史解释的解释结论有时并不具有终局性,而是需要有来自其他解释方法的理由配合或验证保障。

      Historical interpretation is a legal interpretation method that serves a reasonable legal interpretation objective and has relative independence. It explores the legislative intent when laws were formulated by examining the legislative process and utilizing legislative historical materials, but does not stop at discovering the legislative intent that can be rejudged or reassessed. From the perspective of argument reasons for legal application, historical interpretation of statutory law can have independent, restrictive, decisive, and supplementary argumentative effects. Interpretations based on the pre-life history, the creation history, and the application and development history of the norm are the realization paths of the argumentative effects of historical interpretation. The necessary space for interpreting legal norms beyond the text and the rationality of the interpretative tendency formed by legislative historical materials are the prerequisites for the argumentative effects of historical interpretation. Historical interpretation also has its operational boundaries. Firstly, it cannot fundamentally depart from the possible semantic limitations of legal texts. Secondly, legislative intent should not be interpreted in an absolute or single-facet manner and historical viewpoints should be judged prudently based on changes in social reality. Thirdly, the strength of the argumentative effect of historical interpretation is limited by the clarity of legislative intent. And lastly, historical interpretation sometimes does not have finality in interpreting statutory law, and the relevant interpretation conclusions also need to be supported or verified by reasons from other interpretation methods.
