文化是制度的渊源与根基,制度推进文化的弘扬与传承。从文化传承的视角来审视中国传统法典编纂,更可以透视文化与制度的关系。中国传统法典编纂的外在形式,展示了其文化的形式之美;法典编纂的“祖制”情结,凸显了其文化的连续性;法典编纂的“因时”特征,突出了其文化的创新性;从政治法律文化角度而言,法典编纂的“治吏”色彩,突出了其文化的核心要义;就更宏阔的文化而言,法典编纂的“共同体”意识,凸显了其文化的“铸牢”力量。传统法典编纂在文化传承中进行,本身亦可视为一种文化。传统法典编纂体现了文化自觉与法治建设的关系,为当代文化传承与现代法治建设的互动提供了一个生动范例。

英文摘要:

Culture is the source and base of institutions, and institutions can accelerate the promotion and inheritance of culture. From the perspective of cultural inheritance, law compilation in ancient China can provide a better insight into the relationship between culture and institutions. The external form of law compilation in ancient China demonstrated the formal beauty of Chinese cultural. The “ancestral”complex in the law compilation highlighted the continuity of culture. The characteristic of “adapting to the times” in the law compilation highlighted cultural innovation. From political, legal, and cultural perspectives, the “governance of officials” color in the law compilation highlighted the core spirit of culture. And in terms of the broader culture, the consciousness of “community” in the law compilation highlighted the “cementing” power of culture. Law compilation in ancient China was carried out in the process of cultural inheritance, thus can also be regarded as a form of culture. Law compilation in ancient China reflects the relationship between cultural consciousness and the construction of the rule of law, thus provides a vivid example of the link between contemporary cultural inheritance and the construction of the modern rule of law.
