作者认为，法学界关于信托法律性质的诸学说均有合理之处也都不尽完善，应当从信托法作为特别法的角度来认识信托的法律性质。作者还对信托财产所有权与利益相分离、信托财产独立性、信托责任有限性、信托管理承继性等进行了探讨

英文摘要:

The author thinks the various existing theories on the legal characteristics of trust are rational in some way but perfect. The nature of trust should be understood from the point that the law of trust is a special act in the civil law system. The author also discusses the concepts, such as the separation of the interests from the ownership of trust property, the independence of trust property, the limitation of trust liability and the succession of the trust management.
