| 前沿性的犯罪构成理论在宏观上应关注这样一个事实：在活生生的社会现实中，由极其复杂的权力机制决定了犯罪的成立与否，所以不能仅基于国家权力来讨论犯罪构成。实际上，正是在国家权力和非国家的行为评价机制间不易察觉、难以描绘的冲突与调和、抗争与妥协的运动过程中，沉寂的事实要素最终得以生成为被法律框定、具有形式意义的犯罪构成要件事实，从而填充着犯罪构成框架结构中的空域。 |

| This article focuses on the necessity of non-state behavior evaluation mechanism to crime proved. The author discloses the illusory and ineffable campaign course of crime proved. Based upon the survey on the different function of state power and non-state behavior evaluation mechanism, the author concludes that in animated social reality, the dreary factum elements are finally built into crime constitutional element fact through non-state behavior evaluation mechanism as well as the force of state. |
