历来学者多认为汉魏晋时期的比是比附。本文对大量文献史料中的比的运用情况进行了分析，认为比不是比附而是在各方面有普遍约束力的成例，其中经过汇编的某些比是具有法律约束力的判例。

英文摘要:

Scholars have inclined to take bi (analogy) in the period of Han, Wei and Jin dynasties for bifu (additional analogy). This paper, with the analysis of how bi was used as recorded in a large quantity of historical documentation, holds that bi was precedent rather than bifu and those edited precedents had legal binding force.
