本文利用兵书、史传和出土简牍等材料，简略介绍了兵家主要代表人物的法律思想，着重分析了兵家学派法律思想的演变、基本内容与特点、认识基础及与儒法二家的关系等共同性问题。文章认为兵家具有较为深入和系统的法律思想，对以法治军中的主要问题均有独到的见解，对法家思想有深刻影响，从而对先秦法治理论和军事法基本原理的形成作出了重要的贡献。

英文摘要:

This article explores the legal thoughts of the Bingjia (military strategist)in the Spring and Autumn and Waring States periods(770一221BC) by using the ancient documents and the unearthed relics. The author holds that Bingjia put forward the basic doctrine of the military law, which had influenced on the form of the ancient theory of the rule of law.
