构建再审程序的立法指导思想应从“实事求是，有错必纠”转换为兼顾纠正错误裁判与保持生效裁判的稳定。改造这一程序的具体路径是取消法院依职权发动再审，完善检察机关的抗诉监督，建立规范的再审之诉，重构再审的法定事由。

英文摘要:

The legislative guiding principle for establishing the review procedure should be changed.In order to remold this procedure, the power of courts to initiate review should be removed, the system of cont roversial supervision by procucraterates be perfected, normal review procedure be established, and legal reasons for review be redefined.
