| 处于全球化进程中的当代中国法制现代化，具有独特的历史传统和社会条件。在这一变革进程中所建构和发展起来的法律制度，应当捍卫法律主权，反对新的法律殖民主义，防止中国法律发展的“边缘化”趋势。全球性法律重构进程，非但没有形成全球法律发展的一体化趋势，反而加剧了全球社会的内在分裂，强化了以民族国家为构成单位的全球法律发展多样性的演进趋向。 |

| Legal modernization in modern China in the process of Globalization has its unique historic tradition and social condition. The legal system constructed and developed in this process of change should uphold legal sovereignty, fight against new legal colonialism and prevent Chinese legal development from marginalisation tendency. This has become key issue in the process of Chinese legal modernization. The global reconsturction of law has not led to the global integration of legal development, but on the contrary worsened the interior splitting of the society and strengthened the evolution trend of diversity in the glable legal development taking place in indvidual nation state. |
