| 物权种类及其内容的确定 ,是物权立法的首要工作。因为我国有独特的社会体制与国情 ,物权法在确定物权的种类及其内容的时候肯定要遇到许多要点难点问题。这些问题有些已经得到解决 ,有些尚未解决。尚待解决的要点难点主要有国家所有权、集体所有权、企业所有权、私有所有权、不动产所有权以及各种使用权、担保物权等等重要物权类型。 |

| According to the principle of numerous clausus,the definition of classification and the content about ius in rem(sachenrecht)is the first important job for legislation of ius in rem (sachenrecht).Due to the specific social system and state situation in our country ,it’s sure that many difficult problems will be met when the classification and content of ius in rem(sachenrecht) are defined in ius in rem (sachenrecht) law.There are some problems from it solved ,some still left.Some unresolved problems are mentioned in this article，which covers such important types of ius in rem (sachenrecht) as state ownership ,collective ownership ,enterprise ownership，private ownership ,real estate ownership and various using rights ,ius in rem (sachenrecht) for guarantee.A brief discussion about them is given in this article. |
