中文摘要:

执行财产分配制度应当放在整个法律制度的体系中评价。执行分配与破产制度分别实现着个别清偿与平等清偿的目标。就一般破产主义而言，优先主义公平与效率并重，更趋合理；就商人破产主义而言，混合主义更有其独立的价值。如果一般破产主义是一种立法趋向，优先主义代替平等主义或者团体优先主义也是一种立法趋向。眼下我国执行立法所确定的执行财产分配制度仍应为混合主义。

英文摘要:

The system on distribution of properties under enforcement shall be evaluated under the whole legal system.This system is interconnected with the bankruptcy system and both the systerns pursue the harmony of justice and efficiency,though they carry out individual satisfaction and equal satisfaction separately with different functions.As general bankruptcy system concerned,it is reasonable to adopt the "Priority Doctrine" because this principal lays equal emphasis on both justice and efficiency,while the”Mixed Doctrine" has greater value in the case of bankruptcy of merchants.If the general bankruptcy doctrine is a kind of legislation trends,it is also a kind of legislation trends for the "Priority Docarine" to substitute the "Equal Doctrine" or”Group Priority Doctrine".In china,the "Mixed Doctrine" shall still be adopted for the system on distribution of properties under enforcement with respect to the enforcement legislation.Key Word: Equal Doctrine,Priority Doctrine,Group Priority Doctrine,Mixed Doctrine,Distribution of Properties under Enforcement,Bankruptcy System.
