犯罪构成要件是对成立犯罪所必需的各个方面事实特征的抽象、提炼的实体，而犯罪构成要件寓居的方面则是这些事实特征存在的“空间”；构成要件要素是犯罪构成有机整体的最基本因素，属构成要件之下一层次的范畴。将这些范畴混淆，必然造成犯罪构成理论体系内部及与其他理论领域的矛盾。

英文摘要:

The aspect as dwelling for elements of composition is the "space"for these characteristics to exist.The factors of elements of composition of crime is the most fundamental things such as liability,endanger conduct and result厂the author points out the weakness that is not to distinguish the elements the of elements of composition from factors of elements of composition shows when there lacks of"factors" of composition,there must be known as lacking"elements"of composition.Therefore it leads to an wrong theory that in "there is not crime because of lacking elements"(or on the contrary，"the conduct fitting the composition of crime still lacking certain elements").It finally results from the interior composition of crime conflict with the region of relative theory.
