正当程序作为宪法的一项基本原则，已得到世界各国的普遍认可。该项原则既包含程序性限制也包含实质性限制的因素。正当程序运行要求程序合法、主体平等、过程公开、决策自治和结果合理。正当程序原则对于一国的宪政具有法治建构、权力控制和人权保障等功能。

英文摘要:

Due process has been generally accepted as a basic constitutional principle by various countries of the world.The principle comprises both substantial and procedural requirements.The operation of the principle requests legitimacy of the procedure,equality of the subjects,publicity of the process,autonomy of the decision一making and reasonability of the results.The principle of due process may play an important role in the practice of the rule law,control of powers and protection of human rights.
