影响判决书撰写有一系列的制度因素 ,其中包括在不同法系中判决书的不同司法制度功能 ,不同的判决书写作激励机制 ,判决论证的不同社会需求以及判决书的不同预期受众等等。基于中国司法已有的大陆法系传统和相应制约 ,在改进判决书写作问题上 ,中国应侧重借鉴大陆法系国家的相关经验 ,尤其应侧重完善相应的制度激励机制。

英文摘要:

Judgment composition is influenced by variazs institutional factors such as differed functions of judgement in different systans of legal tradition，different stimulating mechanisms for judgement composition，different social demands for woof in judgement，and different expected receivers of the judgement，etc.Since the Chinese judiciary has the tradition of continental legal system,in improving judgement composition，China should lay particular emphasis on relative experiences of countries with continental legal traditions，particularly.
