条约和习惯是国际法的两个最主要渊源。条约规则成为一般习惯法必须具备的条件是 :条约规则具有规则创立性 ;按照条约规则的旨趣形成的国家实践即常例 ;常例被接受为法即法律确信。条约规则成为一般习惯法不仅需要条约当事国按照条约规则的旨趣形成国家实践和法律确信 ,而且更需要非条约当事国按照条约规则的旨趣形成国家实践和法律确信。条约成为一般习惯法较习惯法的其他形成方式有显著的优点 ,但它对当事国及非当事国的影响是不同的。

英文摘要:

Treaty and castoms are the principal resources of the international law.It must fulfill the following conditions before a treaty rule becomes a general castoms law:the rule is creative;state practices have been formed according to the rule;the practices have been accepted as law.The way in which a treaty becomes a general castoms law has its advantages in comparison with other forms of castoms law.However，its influence on the states concerned and not concerned is different.
