住客在宾馆内遇第三人侵害 ,宾馆若疏于注意 ,应承担违约责任。宾馆之不作为违反的是合同义务而非法定义务 ,不能成为侵权行为法上的原因 ,宾馆之不作为与住客之损害不具备侵权行为法上的因果关系。宾馆不应承担消费者权益保护法上的责任。当事人不选择请求权基础时 ,法院应依据查明的事实独立进行法律上的判断 ,民事判决理由不必与当事人之诉讼理由一致。 |

If a lodger is injured in a hotel by the third person owing to the carelessness of the hotel,the hotel should undertake the liability.The Intel's non-action broke the contractual rather than legal obligations.Therefore,it may not become the cause of action in the law of tort,and has no cause-effect reladons with the injury according to the tort law.The hotel should not be heldfor the liability providedfor in the law of consumer protection.If the parties concerned did not choose the claim basis,the court should independently make the legal judgement according to the finding.Cause of action for civil judgement may not necessarily be in compliance with the cause of action for complain. |
