中文摘要:

我国法学研究往往把方法论看作是单一抽象的概念或与方法混同 ,近年来对方法论的研究偏重于法解释学。方法论是一个二元多层次的结构体系 ,其中最常用的有两对方法论范畴 ,即实证分析与规范分析 ,个体主义与整体主义。应当研究如何把西方法学方法论与马克思主义方法论相结合 ,并应吸收我国传统文化中的方法论。

英文摘要:

Our legal studies attach littl importance to methodology ,which is often defined as a single and abstract conception ,or confused with method.In recent years，attention is being paid to the methodology，but mainly from the point of view of science of legal interpretation.In fact ,methodology is distinguished from method ,and also not equal to the science of legal interpretation.It is a multiplex and multilevel constructure.Of the approaches to the legal studies ,two pairs of categories are adopted most often possitive analysis & normative analysis，and individualism&integrationism.In addition ,we should study how to combine western methodology of jurisprudence and Marxist methodology ,and how to develop the perspective of traditional methods in application of jurisprudence.
