“集合犯”在海外刑法理论中是使用比较普遍的一个概念 ,而我国理论界只是在近年才有学者关注。基于我国刑法已经取消了对“惯犯”的规定 ,因此 ,有必要借鉴海外刑法理论对于集合犯的研究 ,联系我国刑法理论和现行刑法的规定 ,对刑法中的集合犯的基本理论问题予以研讨。

英文摘要:

The conception of "the plumed offender" ,which is used usually in overseas criminal law theory,only has gotten canceled fmm our notice recently in our country.Because the conception of "the habitual offender"was criminal code ,the author relates our criminal theory and criminal legislation in effect gives a further discuss on the basic question of the plumed offender on the base of the experiences in orerseas.
