经济宪法学以财产权为基石范畴 ,把公民权利与国家权力的关系理解为个人财产权与国家财政权的冲突 ,并把这一冲突置于产权、人权与政权的相互作用中考察。财产权在公民权利体系中处于核心地位 ,权利保障首先要承认和保障个人的财产权。财政权是国家经济权力乃至一切权力的根本 ,实行宪政必须建立对财政权力的约束。

英文摘要:

The economical constitutional law is based on the right of properties.The relationship between rights and powers should be understood as conflict between individual property right and state budget power，which should be considered in interrelationship among property right，human rights，and political power.The property right is at the core of the rights of citizens and its safeguarding is of first importance in human rights protection.Budget power is fundamental atmng various powers of the state.To control the budget power is the basic requirement of constitutional government.
