中文摘要:

作为一种法律制度 ,前科消灭不仅具有丰富的法律内涵 ,而且还具有厚实的理论基础。我国刑事立法对前科消灭的漠然 ,不能也不应当影响刑法理论对此问题的探讨。随着社会的不断进步 ,有前科者的各种权利必将会受到法律和社会的广泛关注。因此 ,适时有度地在我国刑法典中设置前科消灭制度 ,不失为一种理性的抉择。

英文摘要:

As a system of punishment，abolition of crime record is of rich implications and has solid theoretical bases as well .Despite the indifference in the criminal legislation，the study of it in the criminal theory shoutdn't be effected.With the progress of the society，exconvicts’rights will surely arouse general concern.Therefore，it might be very rational after all to establish the system of abolition of crime record in the criminal code，timely and appropriately.
