中文摘要:

行政契约是游离在行政行为与民事契约之间的一种特殊形态 ,它包含着两个变量 ,一是合意的程度 ,二是存在类似于行政行为的权力因素。基于此 ,应将行政契约定义为“以行政主体为一方当事人的发生、变更或消灭行政法律关系的合意。”在同时兼有这两个变量中的因素时 ,行政契约才能成立。

英文摘要:

Administrative contract is a special form of act between administrative act and civil contract.It consists twa variables:the degree of consensus and the existence of power elements similar to that of administrative act. Therefore，administrative contract should be defined as:"Consensus on the creation，change and extermination of legal relationship with a subject of administration as one of the parties.”An administrative contract can be established only when it contains elements of both variables.
