刑法学犯罪概念研究必须正视而不是回避客观存在的犯罪本质特征 ,犯罪本质特征是社会危害性的基本观点应当得到坚持 ,但犯罪本质特征不是单一的社会危害性 ,而是以社会危害性为中心的矛盾结构。区分立法与司法的不同角度是正确审视犯罪本质特征的关键。立法实践与司法实践应当与犯罪本质特征保持恰当关系。

英文摘要:

How to evaluate the current doctrine on the essential characters of crime is a question that concerns the correct direction of the development of criminal legal practice in China.Researchers on the concept of crime in criminal jurisprudence must face up to，rather than amid，the essential character of crime，which is an objective reality.The stan中oint that the essential character of crime is social harmfulness should be adhered to.However，the essential character of crime is not merely social harmfulness，but a contradiction structure centered on social harmfulness.Making a distinction between criminal legislation and criminal justice is the key to the correct examination of the essential character of crime.Cminal legislative practice and criminal judicial practice should each maintain an appropriate relationship withthe essential character of crime.
