在法律制度体系中 ,知识产权法与科技、经济有着特殊的联系。它是近代商品经济与科学技术发展的产物 ,也是私法领域财产“非物质化革命”的结果。知识产权制度的构建 ,出于知识财产化与产权制度化的合理要求。它的产生与发展 ,是一个科技创新与制度创新的过程 ,也是科技、经济、法律协调发展的过程。

英文摘要:

In a legal system，intellectual property law has special relations with science，technology and the economy.It is a product of n}dern comtmdity economy and the development of science and technology as well as the result of "revolution of non-materialization" of property in the area of private law.The intellectual property law system was established in accordance with the reasonable demand of the propertization of knowledge and institutionalization of property rights.Its emergence and development is a process of technologycal and institutional innovation as well as a process of hartmnious development of science and technology，economy and law.
