中国受众对法庭新闻十分关注 ,媒体在满足公众知情需要的同时亦反映公众对司法的批评。由于缺少共识、缺少规则 ,媒体与司法的关系正处于较不稳定的时期。新闻自由与司法公正、新闻批评与司法尊严、新闻采访与法庭秩序的冲突时有出现。冲突中 ,媒体总体处于强势 ,承载着较多的社会期待 ;而一旦发生诉讼或面对司法权力 ,媒体又处于绝对的弱势。实现平衡的制度框架有待建立。

英文摘要:

News reports from court moms always draw great attention from media receptors in China.The mass media not only satisfies people’s need to enjoy their right to know，but also reflects people’s criticism of the judiciary.Due to the lack of comtmn understanding and relevant rules，the relation between media and the judiciary is experiencing a period of instability.There are frequent conflicts between freedom of the media and judicial fairness，between media’s right to criticize and the j udicial dignity，between reporting right and court order.Generally speaking，the media is in an advantagedposition in these conflicts and carries a lot of expectations of the society.However，once involved in a lawsuit or confmnted by the judicial power，it is often in an absolute disadvantaged position.Therefore，an institutional framework needs to be established to balance between the media and the judiciary.
