Legal-rights constitutional theory is a creative legal theory. Taking the analysis of interest property as its main content,it has demonstrated the important place of power in legal theory,put forward a brand new hypothesis on the relationship between rights,power,and interest property,and,on the basis of such hypothesis,developed a basic legal framework for the analysis of formal legal rights and substantive interest property. However,there are many shortcomings in the legal-rights theory and further improvements need to be made in its research method,its category system,even in the concept of legal right itself. |
