宪法中的基本权利是特定价值观和信仰的宪法化 ,受制于社会现实发展。这些基本权利可以分为三类 ,即自我保存和肯定意义上的古典自然权利、自我表现意义上的公民政治权利及自我实现和发展意义上的社会经济权利。这样划分有利于理解宪法基本权利的不同属性及其思想与现实基础 ,理解其与国家权力的关系 ,以设置不同方式促进其实证化。

英文摘要:

Fundamental rights are the constitutionalization of specific values and beliefs. They are dependent on the development of the society. Fundamental rights can be divided into three categories:classical natural rights in the sense of self-preservation and self-confirmation, civil and political rights in the sense of self-expression, and social and economic rights in the sense of self-realization and self-development.This categorization can help us to understand the nature of different fundamental rights in the constitution, their philosophical and reality basis, and their relations with the state power and to devise various ways to promote the realization of these rights.
