宪法学基础性研究中易出现的错误是混淆宪法现象和宪法学概念 ,将立宪社会现实生活的矛盾、宪法矛盾和宪法学中的矛盾混为一谈 ,误解被抽象对象与抽象结果之间的关系 ,不懂得什么是抽象力以及如何获得和运用抽象力。《法学研究》2 0 0 1年第 4期上发表的周叶中等所写的《宪法学理论体系的反思与重构》一文 ,为这类典型错误提供了种种可用以剖析的例证。

英文摘要:

Some of the frequently made mistakes in the study of basic constitutional law include: confusing constitutional phenomena with concepts in constitutional law study, confusing contradictions in the real life of a constitutional society with the contradictions in the study of constitudo nal law, confusing objects of abstraction with the results of abstraction, and confusion as to what is the ability of abstraction and how to acquire and apply such ability. Mr. Zhou Yezhong’s article "Reflection and Reconstruction of the System of Constitutional Theory"(CASS Journal of Law, No.4 2001), provided us with many examples of the above-mentioned typical mistakes, which will be analyzed in this paper.
