举证责任基本原则是在推定的基础上确定的。但是在每个具体案件中，当案件性质及其举证责任确定之后，推定规则不可能对该案件的已经分配的举证责任产生影响，更不可能导致这种举证责任的转移。

英文摘要:

The basic principle of burden of prove is fixed on the principle of presumption. But in every case, after its quality and its burden of prove of parties are confirmed, it is impossible that the burden of prove will be limited by the presumption, and also it is impossible that the burden of prove will be transferred from one party to another one.
