行政行为的追溯力仅限于执行力。行政行为追溯执行力的根据，是行政行为的可预测性和授益性。行政行为的追溯执行力只是行政行为执行力的一种例外，仅限于行政确认行为、执行法院判决或复议决定而做的行政行为、授益行政行为和紧急行政行为。赋予行政行为追溯执行力的条件是：可预见性、追溯可能性和不影响他人的合法权益。

英文摘要:

The retroactivity of administrative act is limited to the executive force. The retroactive executive force of administrative act is based on the predictability and beneficiary nature of administrative act. Retroactive executive force is only an exception to the executive force of administration act and limited to only acts of administrative confirmation, the execution of the judgment of the court or decisions of recon-sideration, beneficiary administrative act and emergency administrative act. The preconditions for the retroactive executive force of administrative act are predictability, retroactibility, and non-interference with the legitimate rights and interest of others.
