东亚普通法是以古代中国法为质地、中韩日三国独特的交涉为背景而形成的概念。东亚普通法由法典化、儒教法文化、乡约村落法和法学四种要素组成。东亚普通法的发展有赖于东亚人的自觉与成熟态度。

英文摘要:

East Asian common law is a concept developed on the basis of the ancient Chinese law and the unique characteristics of the Chinese, Korean and Japanese laws. It consists of four major elements: codification, Confucius legal culture, local rules and customary laws of villages, and legal study. The development of an East Asian common law depends on the self-consciousness and mature attitude of the East Asian people.
