物权请求权的制度设计以基于所有权的请求权为核心。基于所有权的物权请求权包括所有物返还请求权、所有权妨害除去请求权和所有权妨害预防请求权。所有物返还请求权以相对人无权占有所有物为实质要件。所有物返还请求权的效力应及于孳息，而添附与合理费用原则上得由所有人给予补偿。法律在保护所有物返还请求权的同时应为相对人设置合理之抗辩事由。妨害除去请求权与相邻关系请求权互不相同而又互为补充，共同形成对不动产所有权的法律保护体系。妨害预防请求权应成为独立类型的物权请求权而不应包含在妨害除去请求权之中。

英文摘要:

On the basis of the basic theory of the right of the real claim (sachenrechte), the author examines the ownership-based right of real claim, focusing on concrete regulations, including those on the recovery of belongings, removal of interference in owners吻, prevention against such interference, as well as their respective component parts, legal force, and distinctions from other relevant rights.
