关于单位犯罪的主体结构，理论界和实务部门众说纷纭。考察单位犯罪的主体结构，应该对传统刑法理论予以继承和发展。立足于单位本质的“具体实在说”，单位犯罪是包容自然人的组织体的犯罪，单位犯罪的刑事责任是组织体责任与个人责任的复合，据此，笔者提出单位犯罪“新复合主体论”的观点，主张单位犯罪中单位与直接责任人员之间、单位中多个直接责任人员之间是复合关系，具体体现为直接责任人员相对于单位的依附性和独立性。

英文摘要:

Based on the traditional view of‘concrete existence'of the enterprise in enterprise crime, which means that the enterprise crime is an organizational crime including nature persons, thus the criminal responsibility of the enterprise is the multiple of organizational responsibility and the individual responsibility, the paper suggest s the view of‘new multiple subject s', affirming that in the enterprise crimes, the relationship between the enterprise and the individuals with direct responsibilities, and the relationship among the many individuals with direct responsibilities, are multiple relations, so the individuals with direct responsibilities both adhere and independent to the enterprise.
