The jurisdiction of the ICC provided in the Roman Statute has a distinct character compared with the jurisdiction of national criminal litigation, and that of the prior International Criminal Tribunals. To understand ICC's judicial functions and operating mechanism, as well as the relationship between its jurisdiction and national criminal jurisdiction accurately, we shall make an analysis on the complexity, complementarity and limitedness of the jurisdiction of ICCfrom the aspects of the jurisdiction function, jurisdiction purpose and jurisdiction scope. Besides, it needs some further research of the implied expansibility of the jurisdiction of ICC. |
