| During the building process of the socialist legal rule country, it calls for the reconsideration of the constitutional position and the legal rule value of the Chinese prosecution system. The prosecution power in China is the power of legal supervision, which is the security measure to guarantee the minimum standard of the uniformexecution of the law. Chinese prosecution systemdeveloped and came into being with its unique historical and realistic foundation, yet it still has many common places with that in European continental countries both in the legal theory and in the institutional frame. Our judicial reform shall, established in the general and practical need for the building of a legal rule country, further develop and realize the legal supervision institution of the prosecuting department. Thus the main contents of Chinese prosecution system reform consist in the scientific and reasonable distribution of the prosecution power, and the reform of the management system of prosecuting officers, with the center of the enlargement, reduction and restriction of the prosecution power. |
