The acceptability of a verdict is the core of legal proof procedures, as well as the principal problem of the evidence theories and rules. Under the model of inquisitorial system, the acceptability of a verdict depends on the legitimacy of the procedures, while under the model of adversarial system, the acceptability of a verdict depends more on the objectivity of the facts decided. From these viewpoints, this paper challenges the dialectical materialism epistemology as the philosophical basis of the current evidence law science, and argues that we should introduce the pragmatism properly, making use of its sound elements to reconstruct our proof model. |
