GATT1947第19条规定了“未预见发展”,但《保障措施协议》中对此并没有规定,因此,就保障措施的实施条件形成了肯定说和否定说两种主张。在新近的有关案例里,WTO争端解决机构按照有效解释原则,赋予了“未预见发展”有效的适用,采取了肯定说。

英文摘要:

The‘unforeseen developments' clause under article XIX of GATT has not been included with-in the provisions of the Agreement On Safeguards. Therefore, there have come into being two doctrines about the application of conditions of Safeguards Measure respectively as the positive and negative claims. In the recent cases related, DSB of WTO has adopted the positive claim, appling the‘unforeseen development' clause effectively.
