Organizational personality is a pure legal technique to decide whether an organization has the status of independent owner of property in the field of civil law. Such a concept has neither the property of social politics nor that of the ethical considerations. The conception of personality right is one of the consequences of history, which protects the ethical contents of natural persons'exclusive personality rights, so it doesn't apply to organizational personality in the same meaning. In regard to legal persons'rights of nomination and reputation, they don't contain spiritual interests, which are indeed property rights and don't have exclusive nature. So it is not necessary for the concept of organizational personality to exist anyway. |
