| The aim of interpretation of a will is to find out the subjective intent inside the legator. The formal requirement for the validity of a will should be distinguished f rom the interpretation of a will. By this, we can, on one hand, meet the requirement of form, because the property of a will is a judicial act requiring form, on the other hand, meet the aim of the interpretation. The means of interpretation of a will includes interpretation by words, interpretation by system, interpretation by aim, interpretation by
history, interpretation by customs, interpretation by good faith, and so on. The means of gap-filling of a will includes presumption by analogy and presumption by legal const ruction. |
