在中国现行民事诉讼法面临修改之时，有必要对中国传统民事审判的特质以及从中体现出来的、有着深厚历史文化根基的“德性”进行考察；同时，要以对现代民事诉讼法所体现出来的传统和现代因素的理解和洞察为基础，对将来的民事诉讼法应当如何传承这种“德性”、将体现出怎样的走向以及改革的路径做出展望。

英文摘要:

At the time of the amendment of current Chinese Civil Procedural law, it is necessary that we make an observation on the special characters of Chinese traditional civil trails and its inherent dexing with deep root of historical culture. At the same time, based on the above comprehension and insight of the traditional and modern factors reflected in the current civil procedural law, this article makes a forecast on how the future civil procedural law transmits the dexing, its developing trend and the route of this reformation.
