我国目前由法律和行政法规规定的"其他行政处罚"数量多,分辨难度大,大量本不属于行政处罚范畴的行为被误认为"其他行政处罚"。对"其他行政处罚"的准确认定直接关系到法律的适用和行政诉讼管辖的确定。"其他行政处罚"制度存在的合理尚值得质疑,这是因为对行政处罚采取纯形式标准的分类所致。将来的行政立法应当取消,至少需要限制"其他行政处罚"制度。

英文摘要:

Exactly identifying numerous’other administrative punishments’in Chinese administrative regulations has direct relationship with the application of law and the jurisdiction of administrative cases. The rationality of’other administrative punishments' is examined and the conclusion is that’other administrative punishments' are the result of formal classification of administrative punishments. The legislation should abolish, or restrict at least, the rules of’other administrative punishments'.
