虽然刑事责任理论早就引起我国学者关注,并被引入到刑法学体系之中,但关于刑事责任一些基本问题的认识尚未明晰。特别是关于刑事责任的体系定位与价值认知的冲突、关于刑事责任根据的理解分歧严重影响着刑事责任理论的深入。应当用"改造模式"协调刑事责任的体系定位与价值认知的冲突,用梳理不同范畴关系的方法化解分歧。研讨刑事责任的意义在于吸引更多的人关注刑事责任及其丰富的价值蕴含。

英文摘要:

There are conflicts between the systematic orientation and the value cognition of criminal responsibility.There exist different interpretations of the foundation of criminal responsibility.The’alteration model' should be adopted to resolve the conflicts. And the method of differentiating different categories should be used to acquire a common interpretation of the foundation theory. The study on the issue concerned will attract more attention on the criminal responsibility theory and its great value.
