罪刑法定原则下的刑法适用 ,在很大程度上依赖于对法律的正确解释以及在此基础上的逻辑推理。为此 ,在刑法理论上应当加强法教义学方法的研究。刑法教义学方法中涉及的重大问题包括刑法解释方法论、犯罪构成方法论、案件事实认定方法论以及刑法论证方法论等。有必要从理论与实践相结合的角度对类推解释、犯罪构成类型化特征、事实问题与法律问题的区分、法律论证的必要性等问题进行具体分析。

英文摘要:

Under the principle of a prescribed punishment for a specified crime, the application of criminallaw depends largely on the accurate interpretation and the logical reasoning. Criminologists should fogcus on the methodology of legal argumentation. It is necessary to integrate theory with practice and analconcretely such issues as the analogical interpretation, etc.
