| 在死刑存废的十字路口 ,何去何从不仅是一个理论问题 ,而且是一个实践问题。死刑的存在正如其他事物的存在一样具有自身的历史、社会、政治和经济条件。死刑存在了数千年 ,具有一定的合理性 ,但它也有不合理性。死刑具有不人道性 ,与文明社会的价值观相违背 ,但在某种程度上应否废除死刑仍然是一个“伪问题”。问题的关键不在于应否废除死刑 ,而在于能否和怎样废除死刑。在目前的形势下 ,中国尚不宜宣布立即废除死刑 ,而应该保留死刑 ,但应从立法和执法上对死刑加以限制 ,最终向废除死刑努力。 |

| The issue of whether to abolish the capital punishment is not only a theoretical question but a1l so a practical one. The current debate is lack of considerations of Chinese context. The key issue is not whether the capitalpunishment should be abolished, but whether and how it can be abolished. In current conditions, China should not abolish the capital punishment immediately. As an attempt to abolish the capital punishment at last, it is more practical to limit the punishment within the legal framework. |
