斡旋受贿的职务要件具有职务的非制约性、职务行为的依赖性、第三人意志自由的不完全性和权力可交换性的特点，其“利用职权或者地位形成的便利条件”是指利用职权或者地位形成的能对其他国家工作人员施加职务影响的便利条件，其核心是职务影响力。“不正当利益”分实体违法利益和程序违法利益；“谋取不正当利益”应以行为人明知利益的不正当性为条件，以第三人承诺为具备要件的起点。对第三人中的国家机关工作人员应注意以渎职罪追究责任。

英文摘要:

The constituentelements of mediating bribery bear characteristics as the following:independence from the third official,dependence on one's authority,the incomplete freedom of the will of the third official,and the interchangeability of power. The advantages produced by one’s official status means the influences on other officials. The illegal interests can be divided into substantial interests and procedural ones. Itshould be limited within the scope thatthe one aware of the illegal nature of the interests. The promise of the third official is the startto constitute a criminal offence. The third official should be charged with the crimes of dereliction of duty.
