中文摘要:

交易中的物权归属确定应当区分为以法定公示形式表彰和非以法定公示形式表彰的物权归属确定。不能区分此二者，是造成对交易中的物权归属确定之研究不够彻底的原因。我国物权立法应参酌不同立法例，建立以事实物权、法律物权的基本分类为基础的交易中的物权归属确定的法律制度，并在此基础上确立具象物权的归属确定规则和抽象物权的归属确定规则。

英文摘要:

The confirmation of the real right in the process of transactions ought to be classified into two types; the confirmation of the real right that is manifested by the legal style and the confirmation of the right that is manifested by the non-legal style. The failure of classification leads to the incomplete study of the confirmation of the real right. The legislation of real right in China should consult different legislation styles, on the basis of which we can establish the regulations for the confirmation of the concrete realright and the abst ract real right.
