中文摘要:

中国民法近代化以西方近代民法所体现的人格平等、私权神圣、契约自由、过错责任等私法原则为模范，同时也根据西方近代民法适应技术进步、社会发展在私法原则方面的变化，调整自身内容。中国近代民法的演进，基于西方近代民法从个人本位到社会本位的变化，确定了一条从传统的家庭本位走捷径过渡到社会本位的路线，对于中国近代民法和中国近代社会，均产生重要影响。

英文摘要:

The modernization of Chinese civil law generally follows the Western modern law, adopting its principles of equal personality, holy private right, cont ract autonomy and fault liability as our models. Meanwhile, it adjusts these principles, following changes of Western modern law which happened with the development of technology and society. Compared with the Western evolution from the individual person cornerstone to the social cornerstone, Chinese civil law evolves along a shortcut from the t raditional family cornerstone to the social cornerstone. This speciality inevitably brings important influences to Chinese modern civil law and modern society.
