Gaius first put forward the conception of things incorporeal in juristic sense, and this had a direct bearing on the structure of his Institution——"persons, things, actions".Because in the time of Roman law,the conception of "right" was not present,Gaius'purpose was to bring all the rights differing from the ownership into the scope of "law of things" by the conception of things incorporeal.Once the conception of "right" was abstracted into being and gradually became complete, Gaius’conception of things incorporeal would come to disintegrate. This process rightly reflects the different comprehension of law between the Romans and moderns. |
