"Typology" is a basic method of thinking in interpreting civil law and the theoretic foundation of supplementing loopholes in civil law .Interpretation of civil law should profit from "ideal type" theory of Max Weber, "essence of things" theory of Arthur Kaufmann, and "classification by types" theory of Karl Larenz, while persisting in'SJIarxist legal rational. "Typology" can be applied to civil legislation and justice. Justice is based not only on legislative rules of some type, but also on the detailed rules developed from type rules corresponding to a specific case. |
