在我国语境下，可从国家权力、国家制度、公民权利三个角度理解民主，区分民主的本质与其实现形式，识别民主的功能及其局限。在民主与法治的位阶关系中，两者存在三种基本关系：上下位阶中的决定关系，并列位阶中的互动关系，下上位阶中的从属关系。社会主义法治通过对民主的确认、引导和规制三种主要形式，实现对社会主义民主的保障。社会主义民主法治通过自己特有途径和功能，保障并促进社会和谐目标的实现。

英文摘要:

In Contemporary China, democracy can be understood from the viewpoints of state power, state institution and civil rights, its essence and form of realization should be separated, and its functions and limits should be discerned .As to the relationship between democracy and rule of law, the latter is determined by and subordinate to the former, and they also influence each other. Socialist rule of law conffirms, guides, regulates and safeguards socialist democracy. Socialist democracy and rule of law safe guard and promote the realization of socialist harmony through special ways and functions.
