Based on the idea of public right, our employee’s invention property right distribution system is absolutely unilateral. It violates legal principles and economic rules, bruises the invention enthusiasm of inventors and blocks up the progress of our science and technology. All the tendency of our "giving preference to employer", the American principle of "giving preference to employee" and the "eclecticism" of France have defects of partiality. The way of distributing such property right should be classified, and a new system should be constructed based on the account of investment and centered on property right co-ownership and risk co-burden. |
