| Our legal system, including a lot of laws, administrative regulations and local regulations, has been formed in a very short time of 32 years, which shows the rapidity and intension of the forming course of our legal system. These features also have some influences on the legal study, that is, make the legal study before the formation of our legal system centers its attention on legislation. Such legislation-centered mode approaches legal study with function design and norm construction, introduces foreign legislative materials on a large scale, and constructs the academic guiding directed by legislation. Such mode has contributed a lot to the construction and amplification of our legal system. However, with the formation of our socialist legal system, the legislation-centered mode cannot continue itself any longer, and its implied academic defects become more and more obvious. Thus the legislation-centered mode cannot satisfy the request of the development of rule of law any more, and has to be transformed into a new study mode. In the construction of a new study mode after the formation of our legal system, the academic orientation centered on Chinese problems should be established, the discovery and discussion of Chinese problems should stand on Chinese scenes, the international exchange of legal knowledge should be based on an equal attitude, the new problem-oriented comprehensive study should be expanded, and the study on legal interpretation should be endowed with due mission in our times. Still, the construction of a new study mode depends on the repeated exploration and abstraction of the legal study as an academic practical action. |
